Art. 1 Terms and Conditions for Entering

 

1. The responsible organizer is Karaca Porzellan Deutschland GmbH, whose registered office is at GmbH, Vogelsanger Weg 80, 40470 Düsseldorf, hereinafter referred to as the “Operator". The Giveaway is in no way affiliated with Instagram and is in no way sponsored, endorsed, supported or organised by Instagram. By participating in the giveaway, the participant agrees to the terms and conditions of participation.

 

2. Participation in the giveaway is not linked to any costs or purchase of goods and/or services.

 

3. Entrants must be over 18 years old on the date of their entry and they must reside in EU or Switzerland. Employees Karaca Porzellan Deutschland GmbH are not eligible to participate in the giveaway. The winner(s) will then be randomly selected and announced on Instagram. Participants consent to be announced by the operator in the form of a comment and/or contacted via Instagram Messenger after the giveaway has concluded.

 

4. The Operator reserves the right to exclude any person from the giveaway who manipulates or attempts to manipulate the entry process, the system and/or the giveaway and/or violates the entry conditions. If the expelled entrants is a winner in the giveaway, the prize may be canceled later and a substitute winner may be choosen.

 

5. The prize will only be valid within the EU and Switzerland. Legal representatives, employees, distributors and partners of the Operator as well as all persons who contributed to the creation and implementation of the giveaway and family members of all the persons mentioned cannot participate in the giveaway. Technical or other problems that are not related to the Operator are not the responsibility of the Operator.

 

Art. 2 The Giveaway Period

 

The giveaway will be held between 02.05.2025 at 1.00 p.m. and 09.05.2025 at 1.00 p.m. Participations made after the specified date and time will be invalid.

Participation in the giveaway is only possible within the framework of the conditions stated here. By participating in the giveaway, the participant is deemed to have expressly accepted these conditions of participation. The Operator reserves the right to cancel or terminate the giveaway at any time and without prior notice and without giving any reason.

 

Art. 3 Participation

 

1. Entrance is free.

 

2. Entrants are required to follow @karacadeutschland account.

 

3. They must like the giveaway post.

 

4. They must tag/mention one of their friends over comments of the giveaway post from their own accounts, otherwise entrance will not be considered valid.

 

5. Each person can enter only once in the giveaway.

 

Art. 4 Deadline for participation

       

The giveaway will end on 09.05.2025 at 1:00 p.m. Winner will be announced under the post on 09.05.2025 at 8:00 p.m. The winner will be drawn randomly and will be contacted via DM.

 

Art. 5 Procedure of The Giveaway and The Gift

 

1 (one) Karaca Elegance Bone Siena 53-Piece 12-Person Dinner Set Gold will be gifted to 1 (one) person among all entrants.

 

Art. 6 Notification of the Prize to the Winner and Acceptance of the Prize

 

1. After the giveaway, the winners will be tagged under the relevant post and the winners will also be notified via DM. No warranty is granted for this notification to the winners.,

 

2. Winners will be notified via the Direct Message function of the Instagram platform on Instagram. Winners are obliged to send their contact and address details to Karaca Porzellan via ‘Direct Message’ within 5 working days (following the notification of winning). If the winners do not confirm their acceptance of the prize within this period, the right to the prize will be cancelled without any right to compensation. In this case, a substitute winner will be determined by applying the same procedure. There is no obligation to accept the prize.

 

3. The entrant is responsible for the accuracy of the contact information that provided. In case of incorrect allocation of the prize due to false information, the prize will be void.

 

 

Art. 7 Profit processing and costs

               

It is not possible to pay prize value as cash or change the prize.

 

The prize that given to the winner may be assigned or transferred to third parties only with the prior approval of Karaca Porzellan Deutschland GmbH.

 

The responsibility for any taxation of the prize is on the winner. If the Operator is unable to award the prize for reasons that are not under its responsibility, the Operator reserves the right to give a substitute prize of equal value.

 

Art. 8 Early Termination

 

We reserve the right to cancel the giveaway in whole or in part or to end it prematurely or to change the course of the giveaway at any time, even without adhering to deadlines, if this is due to technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons or for reasons of force majeure, it is not possible to guarantee that the giveaway will be carried out properly. In such a case, the entrants are not entitled to any claims against us.

 

Art. 9 Miscellaneous 

 

1. If certain terms of entrance are or become invalid, the remaining terms of entrance remain valid. We reserve the right to change the terms of entrance at any time.

 

2. The entrants do not have the right to take any legal action.

 

3. These terms and conditions are governed in accordance with the laws of the Federal Republic of Germany.

We hereby inform you about the processing of your data in connection with our social media sweepstakes in accordance with Article 13 of the DSGVO (General Data Protection Regulation).

 

Purpose of Processing Your Data

 

In the case you participate in our sweepstakes on Instagram, we process your data (Instagram profile name) to run the sweepstakes process and inform you if you win. This data processing will be carried out on the basis of your consent in accordance with Article 6, paragraph 1(a) of the General Data Protection Regulation (DSGVO). Furthermore, we process the additional data (address, date of birth) of the winner to enter in the details of the prize. This data processing will take place on the basis of the fulfilment of contractual obligations pursuant to Article 6, paragraph 1(b) of the General Data Protection Regulation (DSGVO).

 

You can cancel your consent to participate in the sweepstakes at any time and without giving any reason by deleting the comment you made under the post we shared on Instagram.

 

The operator of the sweepstakes is responsible for the processing of the data.

Transfer of Data

 

The data of the winners will be transferred to us for the purpose of sending the prize. The transfer is based on subparagraph (b) of paragraph 1 of Article 6 of the General Data Protection Regulation (DSGVO), which stipulates the processing of data for the performance of contractual obligations. We may transfer your personal data to other companies, for example to send you prizes through shipping service providers.
